1. Acceptance of Terms

Welcome to Kaabhi.

These Terms and Conditions of Use (“Terms”) govern access to and use of the Kaabhi online platform, available at https://kaabhi.com.

By accessing, browsing, creating an account, listing products, making purchases, or otherwise using any feature of the Platform, you represent that you have read, understood, and fully agree to these Terms.

If you do not agree with any provision contained herein, you should not use the Platform.

1.1 Relationship with Other Policies

Certain services and activities on the Platform may also be governed by specific policies, including the Privacy Policy, the Cookie Policy, the Return and Refund Policy, the Shipping Policy, the Copyright and Intellectual Property Policy, the Vendor Agreement, the Seller Handbook, and any other policies published by Kaabhi.

These policies complement these Terms and should be read together with them. In the event of a conflict between these Terms and a specific policy, the more specific policy on the matter at hand shall prevail.


2. About Kaabhi

Kaabhi is an international marketplace specializing in clothing, accessories, and products related to Indian fashion, culture, and craftsmanship.

The Platform connects buyers and independent sellers, enabling the marketing of products through stores operated by third parties.

3. Definitions

For the purposes of these Terms:

Platform: the website and services made available by Kaabhi.

User: any person who accesses or uses the Platform.

Buyer: a user who makes purchases through the Platform.

Seller: an independent merchant authorized to list and sell products on the Platform, subject to the Kaabhi Vendor Agreement.

Order: a purchase request made by a buyer.

Account: a registration created by the user to use the services.


4. Nature of the Marketplace

Kaabhi acts solely as a technological intermediary between buyers and sellers.

Unless expressly stated otherwise, Kaabhi:

  • Does not manufacture products;
  • Does not produce the listed items;
  • Does not own the products sold by sellers;
  • Does not act as the legal representative of sellers;
  • Does not guarantee the specific quality of products offered by third parties.

Each seller is solely responsible for:

  • Their products;
  • Inventory;
  • Descriptions;
  • Images;
  • Warranties;
  • Compliance with applicable laws;
  • Customer service;
  • Tax obligations.

Kaabhi is not a direct party to the sale agreement, nor to the shipping agreement entered into between buyer and seller. These transactions occur directly between the respective parties, as detailed in Kaabhi’s Return and Refund Policy and Shipping Policy.

The specific operational and legal obligations of sellers are detailed in the Vendor Agreement and the Seller Handbook.


5. Eligibility

To use the Platform, the user must:

  • Have full legal capacity to enter into binding contracts under applicable law;
  • Provide true, complete, and up-to-date registration information;
  • Comply with these Terms and all applicable laws.

The Platform is intended for individuals who have reached the legal age of majority. Minors may use the Platform only under the authorization, supervision, and full legal liability of their parents or legal guardians.


6. Account Registration and Security

The user is exclusively responsible for:

  • Keeping account login credentials safe and strictly confidential;
  • Not sharing access passwords with third parties;
  • Updating contact and shipping information when necessary;
  • Immediately reporting any unauthorized access or security breach to support@kaabhi.com.

Kaabhi reserves the right to suspend or terminate accounts suspected of fraud, misrepresentation, or unauthorized security breaches.


7. Products and Information Accuracy

Sellers are solely responsible for the accuracy and legality of the information presented in their product listings, as detailed in the Seller Handbook and the Vendor Agreement.

Although Kaabhi strives to maintain overall catalog quality, it does not warrant that:

  • All product descriptions are completely error-free;
  • Digital images perfectly reflect exact physical product shades;
  • Information provided by independent sellers is exhaustive or continuously updated.

Obvious typographical errors in price, stock availability, or item specifications may result in order cancellation and immediate buyer refund.


8. Handmade Products and Artisan Variations

The majority of garments and goods cataloged on Kaabhi are crafted using traditional handloom, embroidery, or artisan techniques.

Consequently, minor variations may naturally occur in:

  • Dye shades and fabric color lots;
  • Weave patterns and natural organic slubs;
  • Hand-embroidery alignment or embellishment positioning;
  • Slight measurement tolerances inherent to hand-cut apparel.

These minor variations reflect genuine handcraftsmanship and do not constitute product defects or misrepresentations.


9. Sizing and Measurement Responsibilities

Sizing standards used by ethnic apparel manufacturers may vary significantly from Western or international off-the-rack sizing.

Buyers are strictly responsible for reviewing product size charts and garment dimensions before confirming an order.

Kaabhi and its sellers are not responsible for size return requests when the delivered garment matches the published sizing chart selected by the buyer.


10. Customized and Made-to-Order Products

Tailored garments, custom-stitched lehengas, or items manufactured to buyer-provided measurements are subject to specific conditions.

Unless required by mandatory applicable consumer laws, custom or made-to-order garments:

  • May not be canceled once fabrication or tailoring has commenced;
  • Are non-refundable for change-of-mind reasons;
  • Remain fully covered for proven physical manufacturing defects or transit damage.

11. Order Acceptance and Cancellation

By placing an order, the buyer warrants that:

  • They are legally authorized to use the chosen payment method;
  • The billing and shipping information provided is truthful and accurate;
  • They accept the total order price, applicable taxes, and logistics terms.

Order checkout completion does not constitute final binding acceptance. Orders may be canceled in exceptional situations, including stock depletion, suspected fraud, system errors, or violation of these Terms.


12. Payments and 14-Day Escrow Holding Period

Kaabhi utilizes Stripe Connect and accredited gateways for processing platform transactions.

By completing a transaction, the user acknowledges that:

  • Payments are securely handled by third-party payment infrastructure;
  • Kaabhi does not store credit card security numbers (CVVs);
  • Issuing banks or card networks may assess foreign exchange or transaction fees.

14-Day Escrow Mechanism: Funds paid by buyers are held securely by Kaabhi. Once the order status is updated to “Completed”, a mandatory 14-day escrow holding period applies before funds are released for payout to the seller. This window affords buyers sufficient time to inspect goods and raise support claims as detailed in Section 15 and our Return and Refund Policy.


13. Taxes, Import Duties, and Customs Charges

Cross-border shipments may be subject to customs tariffs, Import Taxes, VAT, or local processing fees imposed by destination authorities.

These government duties are not included in the item purchase price or standard shipping fee paid at checkout.

The buyer is solely responsible for settling all import duties or customs charges required by local tax laws to clear incoming shipments.


14. Logistics and International Delivery

Kaabhi operates as an intermediary marketplace and is not a direct party to the freight contract formed between buyer and seller. Shipping costs, carrier choices, and processing timelines are determined by sellers in compliance with Kaabhi’s Shipping Policy.

Delivery estimates are non-binding operational targets. Delays resulting from customs clearance, weather anomalies, courier backlogs, or force majeure events are beyond Kaabhi’s direct control.


15. Returns, Refunds, and Dispute Window

Returns, replacements, and order disputes are governed by Kaabhi’s Return and Refund Policy.

Buyers have 14 calendar days following confirmed package delivery to inspect items and initiate a support claim through their account panel or by contacting support@kaabhi.com. During this escrow window, funds remain held by Kaabhi.

Claims or return requests will be denied if:

  • Submitted after the 14-day window has expired;
  • Items show evidence of wear, laundering, alteration, or odor;
  • Original tags or garment packaging have been removed;
  • The item was custom-made to measure without manufacturing defects.

16. Chargebacks and Financial Disputes

Before lodging a dispute or chargeback with a credit card company or banking institution, the buyer agrees to contact Kaabhi’s support team to resolve the issue directly.

In the event of an external chargeback, Kaabhi reserves the right to provide order tracking details, communication logs, and dispatch proof to payment networks. Fraudulent or abusive chargebacks will result in immediate buyer account termination.


17. Seller Operational Obligations

Sellers registering on the Platform agree to uphold high standards of business conduct as set forth in the Vendor Agreement and Seller Handbook, including prompt dispatch times, accurate inventory updates, courteous buyer communication, and strict intellectual property compliance.


18. Intellectual Property Ownership

The Kaabhi brand name, logos, digital layout, user interfaces, database compilations, and platform software are exclusive property of Kaabhi protected by copyright and trademark laws.

19. Content Published by Sellers

Sellers warrant that they own or hold explicit licenses for all photos, descriptions, and media uploaded to the Platform. Sellers assume full liability for third-party infringement claims arising from their published media.


20. Prohibited Conduct

Users and Sellers are strictly prohibited from engaging in any of the following activities on Kaabhi:

  • Using the Platform for illegal transactions, money laundering, or fraudulent activity;
  • Listing counterfeit, replica, stolen, or unauthorized branded goods;
  • Bypassing platform checkout processes or soliciting off-platform payments to circumvent fees;
  • Scraping, crawling, or reverse-engineering Platform software or content;
  • Uploading malicious code, viruses, or disruptive digital tools;
  • Harassing, threatening, or abusing buyers, sellers, or Kaabhi support staff.

21. Disclaimer of Warranties

The Platform and all marketplace services are provided on an “as is” and “as available” basis without express or implied warranties of any kind. Kaabhi makes no representations regarding continuous uninterrupted uptime, complete error-free catalog descriptions, or merchantability of third-party goods.


22. Limitation of Intermediary Liability

To the fullest extent permitted by law, Kaabhi shall not be liable for indirect, incidental, consequential, or punitive damages, lost revenues, or delivery delays resulting from independent seller operations or international freight disruptions.


23. Indemnification

You agree to indemnify, defend, and hold harmless Kaabhi, its directors, officers, employees, and agents from any claims, damages, liabilities, or legal expenses arising from your violation of these Terms, misuse of the Platform, or breach of third-party rights.


24. Modifications to Terms and Platform Services

Kaabhi reserves the right to update or modify these Terms at any time by publishing the revised version on https://kaabhi.com with an updated “Last Updated” date. Continued use of the Platform after modifications indicates acceptance of the updated Terms.


25. Governing Law and Legal Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws, without giving effect to conflict-of-law principles. Any legal disputes arising from Platform usage shall be submitted to direct resolution or competent local courts.
