Last Updated: August 04, 2026
1. Introduction
Kaabhi (“Platform”, “Marketplace”, “we”, “our”) respects the intellectual property rights of third parties and expects all users, sellers, and visitors to do the same.
This Copyright and Intellectual Property Policy (“Policy”) establishes the guidelines and formal procedures for reporting alleged infringements of copyrights, trademarks, industrial designs, product photography, proprietary logos, trade dress, and other intellectual property rights across the Kaabhi marketplace platform hosted at https://kaabhi.com.
Kaabhi reserves the right to immediately remove infringing content, suspend listings, withhold vendor payouts, or permanently terminate accounts that violate this Policy.
This Policy operates in direct conjunction with Kaabhi’s Terms and Conditions of Use, the Vendor Agreement, and the Seller Handbook. All users and sellers remain bound by these governing documents.
2. Scope of Protected Intellectual Property
The following assets published or displayed on Kaabhi are protected by global intellectual property laws, agreements, and international treaties:
- Original photographs, catalog images, and product staging;
- Product graphics, brand icons, and digital banners;
- Trademarks, trade names, brand logos, and trade dress;
- Product descriptions, blog articles, and promotional text;
- Illustrations, drawings, and artistic textile motifs;
- Audiovisual material, product videos, and promotional clips;
- Original textile weave patterns, embroidery layouts, and proprietary garment designs.
3. Seller Legal Representations & Warranties
Sellers assume sole legal and financial responsibility for all content, images, titles, and product listings published under their account.
By listing products on Kaabhi, the seller explicitly represents and warrants that:
- They hold exclusive copyright ownership or formal written license agreements for all published material;
- They have obtained all necessary commercial authorizations, release forms, and model releases;
- The merchandise offered does not infringe upon any registered trademark, copyright, patent, or design right;
- The content strictly complies with applicable national and international intellectual property legislation.
As set forth in the Vendor Agreement, intellectual property violations will trigger immediate corrective actions, including product removals, escrow payout freezes, and account termination.
4. Authentic Product Imagery Policy
To preserve catalog integrity and uphold buyer trust across the marketplace, sellers must strictly adhere to Kaabhi’s Authentic Product Imagery Policy.
Sellers are required to upload original imagery of the actual products manufactured, stocked, or dispatched by their store. The following practices are strictly prohibited:
- Using third-party brand photos or catalog images without explicit written authorization;
- Scraping watermarked images from external e-commerce portals or search engines;
- Utilizing unauthorized celebrity, influencer, or red-carpet photography;
- Misrepresenting replica or inspired garments using authentic designer photographs.
Failure to comply with imagery authenticity guidelines will result in immediate listing deletion and vendor account suspension.
5. Procedure for Reporting Infringements (Notice & Takedown)
Rights holders or their authorized legal representatives who believe their intellectual property has been infringed on Kaabhi may submit a formal Notice of Infringement directly to:
Email: support@kaabhi.com
To ensure valid processing, the Notice of Infringement must contain:
- Full legal name, business address, and contact details (email and phone number) of the rights owner or representative;
- Identification and precise description of the copyrighted work, trademark, or protected asset;
- Direct URL(s) or link(s) to the specific infringing listing(s) hosted on Kaabhi;
- A good-faith statement that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
- A formal statement confirming that the information provided in the notice is accurate and under penalty of perjury.
6. Review and Enforcing Actions
Upon receiving a valid Notice of Infringement, Kaabhi will review the claim and may take any of the following actions at its sole discretion:
- Request supplementary ownership documentation or registration certificates from the reporting party;
- Temporarily disable or permanently delete the reported listing from search and public view;
- Freeze pending escrow payouts associated with the disputed items;
- Notify the seller and allow a response timeframe for clarification;
- Permanently terminate vendor accounts in cases of severe or repeat violations.
7. Seller Counter-Notice Procedure
If a seller reasonably believes their product listing was removed or suspended as a result of mistake or misidentification, they may submit a Counter-Notice to support@kaabhi.com.
The Counter-Notice must include:
- Seller’s full legal name, business address, and registered email;
- Identification of the material removed and its previous URL location;
- Documentary evidence verifying authorization, licensing rights, or original creation (e.g., invoices, design files, license contracts);
- A statement made under penalty of perjury that the seller has a good-faith belief that the material was removed by mistake or misidentification.
Kaabhi will evaluate the evidence submitted and determine whether to reinstate the listing.
8. Repeat Infringer Policy
Kaabhi enforces a strict repeat infringer policy. Accounts determined to have repeatedly uploaded unauthorized content, counterfeit items, or non-compliant imagery will have their selling privileges permanently revoked and store profiles deleted without prior warning.
9. Kaabhi Proprietary Marks
The “Kaabhi” name, brand logos, custom graphics, platform software, layout designs, and compiled catalog databases are exclusive property of Kaabhi.
No party is permitted to reproduce, frame, modify, scrape, or distribute Kaabhi’s proprietary assets without prior written consent.
10. Limitation of Intermediary Liability
As a technology and intermediary marketplace provider, Kaabhi does not perform pre-publication review of all vendor listings uploaded to the Platform.
Kaabhi fulfills its intermediary obligations by responding promptly to valid notices of infringement, removing unauthorized materials, and maintaining transparent compliance channels.
